A Russell County jury says an 18 year old is guilty for sexually assaulting an elderly woman in Phenix City. Members of the jury went out to deliberate atTim Reid treid@wrbl.com news 3 on your side
eleven o'clock Tuesday morning. And two and a half hours later they found Javarous Hall guilty of rape, sodomy, kidnapping and robbery. While the verdicts were read, Hall showed no emotion. He took the stand earlier and claimed that it was another man who raped the 82 year old victim and not him. Hall admitted to robbing the victim and kidnapping her, but told the court he didn't commit the sexual assault. But after hearing testimony from medical experts, the jury found
him guilty. After swabbing the elderly woman's hands, his DNA was found. The crime happened at the victim's home on Summerville Road on August 7th, 2007.
The 82 year old victim was watering her plants when Javarous Hall came up from behind her and forced her into the home at gun point. He then robbed the
victim, tied her up and raped and sodomized her. Prosecutor Max Smith says he was pleased with the verdict, but defense attorney Walt Gray says he was disapointed because he believe the wrong man was found guilty despite Hall admitting to the robbery. “She wanted her day in court and got it and I think the only one happier then me is her and her daughters. And they are very glad with the result” Smith said. “My client basically says that he was the one that had the idea to go rob someone. He was the one that picked the house and was the one who led the break in” Walt Gray tells News Three. Javarous Hall could get 20 years to life on all four charges. He is being held at the Russell county jail until sentencing. Hall will be sentenced on October 22nd.
