Phenix City police officer charged with raping a woman in custody

PHENIX CITY, Ala (WRBL) - A Phenix City Police Officer is charged with raping a woman he was transporting her to the Russell County jail in handcuffs. 

Russell County Sheriff Heath Taylor says the incident happened on January 29 around 8:00 p.m.  Taylor says the officer, 35-year-old Eldrick Deron Kennedy, took the woman into custody at the Piggly Wiggly on the Highway 280 Bypass on a shoplifting charge.  Taylor says while in transit to the jail, the officer pulled over and had sex with the woman while she was still handcuffed.

The victim reported the crime on Thursday, February 1.  When authorities questioned Kennedy during the investigation, Sheriff Taylor says he admitted to the elements of First Degree Rape.  Taylor says the only difference in Kennedy's story and victims is that Kennedy claimed it was consensual.  Sheriff Taylor said, "We all know that there is no consensual when you are in custody, so that does not play a part in this case."

Kennedy was arrested Thursday and charged with Rape 1st degree, which is the most serious of the rape offenses.  Kennedy saw a judge this morning and is now in being held in the Russell County Jail on a $60,000 bond. It is not known at this time whether Kennedy has made bond, but if he hasn't, Lee County Sheriff Jay Jones has agreed to hold Kennedy in the Lee County Jail.  This is a precaution that would be taken to protect inmates in the Russell County Jail.

Kennedy worked for the Phenix City Police Department for five years.
