GREENEVILLE, TN (WJHL) -

A Greeneville Police Department auxiliary officer is in federal custody accused of searching for child pornography while on duty in a patrol car on a police computer.

Federal prosecutors provided us with a criminal complaint that charges Herbert Eugene Miller with one count of receipt of child pornography and one count of possession of child pornography.

"All we can say is what is in the public record: the FBI arrested Miller yesterday, he was a Greeneville PD auxiliary officer, and he has been temporarily detained pending a detention hearing next Wednesday, August 21, 2013, at 1:30 pm," Assistant U.S. Attorney Neil Smith said.

According to paperwork filed in federal court, earlier this month a Greeneville Police Department shift supervisor found several inappropriate web searches on a computer in a patrol car. Those documents say the searches included key words like "fifth grade girls," "naked middle school girls" and "hot high school girls naked."

A subsequent federal investigation revealed thousands of pornographic images on that computer's hard drive, including 80 images of children, the complaint said.

After looking at the police department's shift schedule, investigators concluded Herbert Eugene Miller was in fact the one working out of that patrol car on the day those web searches were completed.

He remains in federal custody pending next week's detention hearing.

The City of Greeneville told News Channel 11 Friday that Miller is no longer employed with the Greeneville Police Department.  

"Once we realized that there was probably some illegal material on this computer we immediately called the FBI to do an investigation," Greeneville City Manager Todd Smith said.

Up until his arrest yesterday, Miller had remained an auxiliary police officer for the Greeneville Police Department since June 2000.

"Auxiliary officers are part-time police officers here," Smith said. "They're fully sworn, fully trained police officers, but they fill in when we have scheduling gaps, folks are on vacation or when we have large events in Greeneville."


The following is a statement from the city and the police department: 

"On Sunday night, August 4, a GPD officer discovered suspicious material on a laptop computer in a police vehicle. The officer immediately notified a supervisor, who immediately notified Assistant Chief Craig Fillers. When it was determined that potential illegal activity had occurred, an immediate internal investigation began. Following the internal investigation, GPD immediately contacted the FBI, who also is conducting an investigation. The officer who is the subject of the investigation is no longer employed with the Town of Greeneville."
