St. Pete cop killer back in court

HERNANDO COUNTY, FL (WFLA) -

Nicholas Lindsey who is serving a life sentence for shooting a St. Petersburg police officer was back in a Pinellas courtroom Monday.

His defense was arguing that under a new Supreme Court ruling Miller vs. Alabama, Lindsey should be eligible for the possibility of parole after serving 25 years.

Lindsey was convicted of shooting Officer David Crawford four times in February 2011.

Monday morning the defense called several witnesses who testified to the high crime neighborhood, Bethel Heights, where Lindsey grew up. His great uncle, Joe Lindsey, spoke on his behalf,"I really think we should do all we can to save lives, don't just throw lives away."

Psychologist Richard Carpenter said Lindsey has a low IQ and a congenital hearing problem.

Finally public defender Stacey Schroeder summed up their case. "He can be rehabilitated, he is not insane nor intellectually disabled. He deserves to be punished for his crime, the punishment should be mitigated based on the hallmark characteristics of youth in general and specific circumstances in this case," said Schroeder.

Pinellas judge Thane Covert also heard from those close to the fallen officer.  "I just want the peace of mind to know I'll never have to walk on the street and run into my father's killer as a free man on the same sidewalk," said Amanda Crawford, officer's daughter.

Pinellas-Pasco State Attorney, Bernie McCabe argued that life in prison without parole was the only just sentence because Lindsey killed a police officer.

The judge said he would re-sentence Lindsey on October 11th.
