Update: McKoon responds to exoneration in investigation called by MCSB

COLUMBUS, Ga. -

State Senator Josh McKoon has responded to the clearing of his name in a GBI investigation with the Muscogee County School Board.

The Georgia Attorney General's Office reported on Friday the case against McKoon and Frank Myers, a local political consultant, cannot be prosecuted because the element of solicitation is not present. In a letter sent this week to the Director of the Georgia Bureau of Investigation, the Senior Assistant Attorney General says that he agrees that this case cannot be prosecuted.

McKoon and Myers were accused of threatening to withhold state funds from the school district if it's no-big contract with their legal firm continued. Hatcher and Stubbs has been the school board's legal counsel for nearly 60 years.

McKoon says the school board is overspending for legal counsel and should open up the bidding process to other law firms. He calls the investigation a waste of taxpayer dollars.

"This entire episode is the result of John Phillips, Rob Varner, AJ Senior, Beth Harris and John Wells' cowardly and desperate attempt to do anything to distract this community from a breathtaking waste of taxpaying dollars from Columbus," says McKoon.

Earlier this year, News 3 spoke to board member John Wells about McKoon's involvement with the board.

"Doesn't he have enough to do up in Atlanta to represent the children and people of Muscogee County? Why can't he get better legislation in Atlanta that would affect all of Georgia and Muscogee County to educate our children," says Wells in a interview with News 3 in March.

McKoon does plan on introducing legislation in the next legislative session. He says he wants legislation passed that will put an end to no-bid legal contracts for school systems across the state of Georgia.

News 3 spoke to several of the board members about the conclusion of the investigation. Board member Athavia "AJ" Senior says she's disappointed with the findings and firmly believes McKoon and Myers crossed the line. No one we spoke with would go on-camera Monday, but board member Beth Harris said a news conference will take place Tuesday.

"I'm ready to move on in a positive direction and try to get the right thing done for this community and I guess we'll wait until tomorrow if the school board wants to move in that direction or if they want to continue down a fairly destructive road," says McKoon.

The probe has been on-going since March.
