Lawsuit filed against "secret owners" of NBRC Construction

HERNANDO COUNTY, FL (WFLA) - The two men who run NBRC Construction are already beset by bankruptcy, civil fines, a theft arrest and an ongoing probe by fraud investigators from the Florida Department of Financial Services. Now, they have a lawsuit on their hands filed by a man who, on paper at least, used to run their company.

Eric Shane Johnson says Carlton DeWayne Dunko and Frank Martin Pureber used him to conceal their own roles managing the roofing company that conducted business in six counties surrounding Tampa Bay.

In a civil lawsuit filed in Manatee County Thursday Johnson claimed that Dunko and Pureber "are using his signature and license in an effort to cover themselves from whatever activities they are conducting."
 
State investigators have logged more than 100 complaints focusing on a business pattern in which NBRC sets up roofing jobs paid for with storm insurance claims and either fails to pay contractors and suppliers or does no work at all despite receiving the insurance proceeds. State investigators say suspect insurance claims amount to 4-5 million dollars. 

Johnson said he quit the company as a "managing member" in February before NBRC stopped its paying bills and completing jobs, but as recently as May Dunko and Pureber were still using his rubber stamp signature to sign company checks.

He also alleges the men set up a related company named Resto Construction registered in Delaware that he knew nothing about. Johnson alleges they used his name as a "registered agent." The suit alleges Dunko and Pureber "have used Plaintiff's signature to set up Resto Construction in Plaintiff's name for illicit and illegal purposes."

Dunko and Pureber are both out on bond after a theft arrest two years ago in Georgia related to their former company American Shingle. Prosecutors in that state haven't decided yet whether to file formal charges. They are also both in individual bankruptcy and corporate bankruptcy related to American Shingle and face a $1.5 million civil fraud fine in Arkansas.

The criminal defense attorneys representing Dunko and Pureber said this week they are no longer affiliated with the men and the bankruptcy lawyer handling their cases in Federal court has asked to be removed.

Dunko and Pureber have refused all requests for comment and fled on foot when an investigative team from Eight On Your Side tried to ask them questions a few weeks ago.
