Police respond to a shooting at Lexington on the Green apartment complex.
RALEIGH, N.C. -
Two Raleigh teens pleaded guilty Wednesday to the murder of 16-year-old Fernando Garibay-Benitez in August 2012.
Garibay-Benitez was shot to death Aug. 15, 2012, at Lexington on the Green apartment complex just a few blocks from where he lived in the Foxhall neighborhood.
Police say Garibay-Benitez was killed in a drive-by shooting.
Police arrested Brayan and Ceferino Hernandez-Sierra, who were 13 and 15 at the time of the shooting, in connection with the shooting.
Wednesday morning, the two teens pleaded guilty to second degree murder.
Brayan was sentenced to at least 30 years in prison. Ceferino was sentenced to at least 26 years in prison.
Prosecutors said the brothers and Garibay-Benitez were in rival gangs. There was no evidence the teens had ever knew each other.
In North Carolina, defendants
typically are not tried in adult court until they are at least 16. But
state law requires anyone 13 or older be transferred to adult court when
charged with first-degree murder.
Garibay-Benitez's cousin, Chris Benitez, said the teen was supposed to be going to the store at the time that the shooting occurred. He was unsure why Garibay-Benitez would have gone to the apartment complex.
