Durham DA to look into anonymous tip in Huerta case

DURHAM, N.C. -

Durham's District Attorney will again look into the death of Jesus Huerta, several weeks after determining there would be no criminal charges.

Huerta, 17, died in the backseat of a Durham Police patrol car in November 2013. Police said he shot himself while handcuffed behind his back.

The case has sparked three marches, protesting police and raising questions about whether the officer who arrested Huerta followed policies and procedures. An internal police probe is still ongoing.

The district attorney looked over findings from the State Bureau of Investigation but found no evidence of any criminal wrongdoing in Huerta's death.

Roger Echols, Jr. issued a statement Tuesday morning on behalf of Durham's District Attorney.

"The attorney for the Jesus Huerta family has requested that we follow-up on an anonymous tip related to the shooting. We have examined the details contained in the tip and met with the attorney and the SBI. We have agreed to look into the material to the extent that it is reasonable and productive, and has a probability of relating to a crime," Echols said.

"We await the results of this follow-up and remain in close communication with the related parties," he said.

Alex Charns, attorney for the Huerta family, issued a statement Tuesday in response to the DA's decision.

"We look forward to the SBI follow-up on the additional investigative area that was identified.  We encourage the SBI, with the consent of the witnesses, to digitally tape-record any follow-up interviews, Charns said. "We look forward to seeing the results of a complete and thorough, professionally conducted SBI investigation after it's finished."
