Driver of car indicted in Cary train incident from Jan. 2

RALEIGH, N.C. -

Benny Derrick Dimery of Laurinburg has been indicted on charges of involuntary manslaughter in a case where his car was struck by am Amtrak train in January, according to a copy of court documents obtained by WNCN.

On Jan. 2, the indictment reads, Dimery "did willfully, unlawfully and feloniously did kill and slay Lauren Ashley Webb."

Cary Police have said a car that was struck by an Amtrak train Jan. 2 may have bypassed the crossing arm at the intersection of Maynard Road and Old Apex Road.

Witnesses say they saw the Mitsubishi Galant on the tracks before it was hit by a train around 11:30 a.m. Thursday.

The driver, Dimery,  was injured in the collision. Dimery's girlfriend, 22-year-old Webb, of Laurinburg, was killed.

Police said the train was heading north to New York at 55 miles per hour at the time of the collision.

The Town of Cary said 291 people, including staff, were on the train.
