Phenix City woman claims police brutality

PHENIX CITY, Ala. - A Phenix City woman faces eye surgery after she says she was the victim of police brutality.

News 3 spoke with Elizabeth Coty-Green after her altercation with police Sunday, May 18. She and her husband Spivey were at home that night when her daughter-in-law came by to pick up some personal items. She had been in a fight with Green's son earlier that day, so she brought along Phenix City officer Mark Cameron.

Green recalls, "I told her it would be best to come back when he's here so they could switch out. The officer told me, no she would get her stuff tonight, and I told him that I didn't have to let neither her nor him in my house, and at that time he told me either I let her in or he was going to arrest me."

Green's husband heard the commotion and came downstairs to talk to the officer outside. Green still refused to let the officer in the house, however, so she says Cameron put his foot in the door and got violent.

"He grabbed me by the shirt and tried to yank me out the door," she says. She says she backed up and held onto the staircase to keep Cameron from pulling her outside, and she got on the phone and asked dispatch to record the confrontation.

Spivey says while trying to protect his wife, the officer put him in cuffs. "
I didn't resist because there was already enough force behind the handcuff," he says, "so I even made the comment, 'just let it be,' just get myself in the cuffs so there wouldn't be no fight."

But the couple says the struggle didn't end there. Green says Cameron wrestled her to the floor and punched her.

She
 says she called for a supervisor when the officer was first talking to her husband, and the lieutenant arrived just after she was punched in the face. "The lieutenant got to the door, and rung the door bell and said, 'open the door,'" she says. "My husband said, 'the officer locked it.' He's sitting there in handcuffs, so the officer unlocked the door. The lieutenant came in and put his knee in the small of my back."

According to an incident report, Green was transported to the jail without incident or injury. Because of her injuries, however, she had to be rushed to Midtown Medical Center in Columbus by ambulance.
An officer accompanied her to the hospital, and told her to turn herself in for Resisting Arrest following her treatment.

Green is also charged with Disorderly Conduct and Assault 2nd Degree, and her husband is charged with Resisting Arrest. 

News 3 has reached out to the city attorney to obtain the 911 recordings of the incident, but we have not gotten a response yet. In the meantime, the Greens have filed charges against the officer and the city, and are asking the FBI to investigate.

Police Chief Ray Smith tells us an officer is allowed to use whatever force he believes is necessary to arrest a suspect, and it's not considered excessive until after they are in cuffs.

Green says she will have to get surgery to fix her fractured eye socket, and still has to visit a neurologist for lasting migraines from the injury.
