Durham District Attorney Leon Stanback said Friday that no additional charges will be filed in the case involving the death of Jesus Huerta.
Stanback, in a news release, said officials had met with Alex Charns, the attorney for the Huerta family, about a call an an anonymous letter received by Charns.
“Following that meeting, SBI investigators began an exhaustive investigation to confirm any of the facts alleged by the anonymous letter. Gun permits, firearm qualifications and firing range records were reviewed. The author of the anonymous letter was discovered, located and interviewed. The anonymous source admitted he reported rumor and conjecture without a factual basis.”
Stanback said in a statement that he was satisfied there was no probable cause for a crime.
Huerta died of a gunshot wound in the back of a police cruiser Nov. 19.
An autopsy said he died from a gunshot wound to the mouth.
His death had his family questioning how he could have been handcuffed in the back of a police cruiser and yet managed to kill himself.
Charns, in a statement Friday, said, “As before, the family of Jesús Huerta has no comment on the District Attorney’s decision. The Huerta family thanks the SBI and the D.A. for following up on the area of inquiry that was identified. I offer my thanks as well.”
