7/6/2017, 9:15 A.M. — The suspect accused of critically injuring a two-month-old baby girl pleads not guilty in a Muscogee County Court.
A News 3 reporter in the court room says 23-year-old Nijil Alston pleads not guilty to the charges of aggravated battery (family violence) and cruelty to children first degree (family violence).
Sergeant Wendy Holland from the Columbus Police Department told the court that police were called to Midtown Medical Center on Tuesday just before noon in reference to an assault of a two-month-old girl. She said the two-month-old girl had fractures on both sides of her skull, old fractures on the ribs, bruising all over her body including her privates.
In court, Sgt. Holland said that Alston claimed he was trying to change the two-month-old’s diaper when she fell off the couch. She said that Alston grabbed her and held her close to his chest. She began to slip and fell onto the cast on his left arm. It is still unknown as to what the child hit her head on.
Sergeant Holland said Alston was not at the hospital when police first arrived because he left out of fear that he would be accused of wrongdoing, but he demonstrated what happened to the child when he was at the police station.
Alston’s attorney, Jennifer Curry, said that DFCS will not allow Alston or his wife to see the baby, which is the family’s main concern.
“He’s a 23-year-old man, grew up here in Columbus, great family, Christian family,” Curry said. “His mother, she was just telling me she wants to go up to Egleston and play some gospel music for the baby. That’s what she loves to hear and listen to. He doesn’t have a violent history at all. He was just very excited to have this new baby.”
A judge issued Alston the following bond amounts:
- Aggravated Battery: $100,000
- Cruelty to Children: 50,000
Case is now bound over to Superior Court
The injured child remains in critical condition with “high cranial pressure”.
