Defense team request new judge in officer involved shooting case

Defense attorney’s for a Montgomery Police officer accused of murdering a pedestrian he stopped in 2016 are making a second attempt to get a new judge in the case. 

The murder trial of former Montgomery Police Officer, Cody Smith, is set to begin in two weeks. However, his defense teams say Judge Greg Griffin should recuse himself.

The defense team says Judge Griffin turned the community against Smith when he said during a previous hearing that he didn’t find Smith’s testimony about needing to use deadly force credible.

The defense also says one of the judge’s sons works with the district attorney’s office — and they believe it’s unfair.
