UPATOI TRIAL: One defendant has now rescinded his guilty plea

MUSCOGEE COUNTY, Ga (WRBL) - Reporter Mikhaela Singleton is bringing you the latest in the Upatoi triple murder case. 

UPDATE: 2:00 P.M.

An attorney for defendant Rufus Burks has requested a change of venue. Judge McBride calls the pre-trial motion "premature" before an attempt at jury selection.

UPDATE: 12:13 P.M. 

Tapley's lawyer discloses to Mikhaela his client felt he had "no choice" but to plead guilty when faced with the state's evidence. He has now rescinded his guilty plea.

UPDATE: 11:45 A.M. 

19-year-old Jervarceay Tapley pleads guilty to three counts of malice murder in Upatoi trial. Tapley confirms to judge McBride he is not under any outside influence.

Sources say Gibson is expected to plead next

"Judge McBride says he will be open to a plea in which the defendant [Tapley] takes some measure of responsibility in the crime committed."

Judge McBride says given the gravity of the charges against [Tapley] and the amount of time that has passed, I'm not inclined to accept the suggested plea."

The long-awaited murder trial in the slayings of a grandmother, a teenage boy and a little girl will begin Monday.

On January 4th of 2016, 54-year-old Gloria Short, her son 17-year-old Caleb Short, and her granddaughter 10-year-old Gianna Lindsey were murdered in Gloria's Upatoi home.

This tragedy sent a shockwave through the community.

Three men were accused and charged in the triple homicide. The men names are 21-year-old Raheam Gibson, 19-year-old Jervarceay Tapley, and 17-year-old Rufus Burks.

Monday jury selection begins in the murder trial of those three men. The family of the three victims have waited two years for their day in court and are looking for justice in the brutal murders.
